Introduction
The m.Net network of websites (‘Network’) is operated by m.Net Corporation Limited ACN 097 086 390 (‘m.Net’). ‘Home and Away’ is a registered trade mark owned by Seven Ltd. m.Net’s business includes the provision of mobile content to customers for the ‘Home and Away’ brand, as well as providing mobile content to customers in collaboration with other clients. Terms & Conditions applicable to the purchase of 'Home and Away' mobile content are available here. Your access to the Network is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Network (known collectively as "Network Terms of Use"). Your use of, and/or access to, the Network constitutes your agreement to the Network Terms of Use. m.Net reserves the right to amend the Network Terms of Use at any time without notice to You.
The Network
Terms of Use are effective until terminated by m.Net. m.Net may terminate this agreement and your access to the Network at any time without notice. In the event of termination, you are no longer authorised to access the Network, but all restrictions imposed upon you, licenses and waivers granted to you, and all m.Net disclaimers and limitations of liability set out in these Network Terms of Use (as amended) will survive.

Intellectual property and restrictions on use of Content on the Network
All content featured or displayed on the Network including, but not limited to, information, text, material, graphics, software and advertisements on the Network including mobile content available for purchase by customers ("Content"), is owned or licensed by m.Net or its related bodies corporate, suppliers and/or licensors, unless expressly indicated otherwise on the Network.
The Content is protected by Australian and international copyright and trademark laws. The purchase of mobile content via the 'Home and Away' WEBSITE is subject to the Terms & Conditions applicable to the purchase of 'Home and Away' Mobile Content. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way except as expressly provided for in the Terms and Conditions applicable to the purchase of 'Home and Away' Mobile Content or, in relation to other Content, as expressly authorised in writing by m.Net.
Strictly on the condition that you keep all Content intact and in the same form as presented on the Network (including without limitation all copyright, trademark and other proprietary notices and all advertisements), you may:
a) using an industry-standard Web browser, download and view the Content for your personal, non-commercial use, or
b) if you are an Internet service and/or access provider, supply the Content to your subscriber. You must not use the Network in any manner or for any purpose which is unlawful or in any manner which violates any right of m.Net or which is prohibited by the Network Terms of Use.
In using the Network, you agree:
a) not to disrupt or interfere with any other user's enjoyment of the Network;
b) not to disrupt or interfere with the security of, or otherwise cause harm to, the Network; and
c) not to collect or harvest personal information, including email internet addresses about Network users. You agree to indemnify and hold harmless m.Net and our employees, contractors, officers and directors, from all liabilities, claims and expenses (including legal costs on a full indemnity basis), that arise from your use or misuse of the Network.

Advertising, links to third party websites and e-commerce offers
The Network may contain hyperlinks and other pointers to Internet websites operated by third parties. These linked websites are not under the control of m.Net, and m.Net is not responsible for the content of any linked web or any hyperlink contained in a linked website. m.Net provides these hyperlinks to you as a convenience only, and the inclusion of any link does not imply any endorsement of the linked website by m.Net. You click through to the link/s to any such website entirely at your own risk. The Network may also contain third party advertisements (including banner ads and full page advertisements) which contain embedded hyperlinks or which include referral buttons to websites operated by third parties or their licensees or contractors. All third party advertising (including referral buttons and embedded hyperlinks) is paid for by the relevant third party advertisers and are not recommendations or endorsements by m.Net or their respective directors or employees. You are referred to the relevant advertiser for all information regarding the advertiser and its products and/or services. In some instances, the advertisement will contain representations or offers by the third party advertiser which you can accept by linking to the advertiser's website and executing the relevant transaction. Such offers are not made by m.Net, and the third party advertiser is solely responsible to You for the delivery of any goods or services you purchase on the third party website.

There are many risks inherent in transmitting information over the Internet. Unauthorised access and faults in computer networks can and do occur which may result in the interception, corruption, alteration, non-delivery, incorrect delivery or loss of information transmitted over the Internet. m.Net does not warrant that its websites will be free from such risks.

Virus Warning
The internet and world wide web are unsecured public networks as such there may exist the risk that information sent to or from this web site may be intercepted, corrupted or modified by third parties and/or files obtained from or through this web site may contain computer viruses or other defects. By using this web site and material from it, You assume these risks and responsibility for any loss, damage or consequence resulting directly or indirectly from these risks. The 'Home and Away' brand identity may be available to you to place on Your own website as a hyperlink to the relevant m.Net website, but such use requires the express written authorisation of m.Net and Seven (Operations) Ltd and any use must be in accordance with the trademark usage guidelines of the trademark owner.

Limitation of Liability
While m.Net does its best to ensure the optimal performance of the Network, you agree that you use the Network and rely on material contained in the Network at your own risk. m.Net does not warrant that that the Network is fit for any particular purpose, that the functions contained in the materials in the Network will be uninterrupted, that defects will be corrected or that the Network is free of viruses and other harmful components or that the content is complete, accurate or reliable. Except as set out below, m.Net and its employees, agents and contractors exclude all warranties whether express, implied, statutory or otherwise, relating in any way to your use of the Network and liability (including for negligence) to You or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage such as loss of revenue, damage to equipment or loss of data) arising from or in connection with any use of the Network. Where any statute implies any term into Your use of the Network and that statute prohibits exclusion of that term, then that term is included. If and to the extent permitted by the statute, however, the liability of m.Net and its employees, agents and contractors for any breach of such term is limited, at m.Net’s option, to the resupply of any services provided to You or the repayment of any fee or part of the fees paid by You.

Applicable Law
The Network is administered by m.Net from its offices in Adelaide, South Australia. These Terms shall be governed by and construed in accordance with the laws of the State of South Australia, without giving effect to any principles of conflicts of law. Any legal proceedings arising out of or in connection with the use of the Network must be commenced in the appropriate court in the State of South Australia. If You use the Network from locations outside of South Australia, You are solely responsible for compliance with Your local laws. If any provision of these Network Terms of Use is deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severed from these Network Terms of Use and shall not affect the validity and enforceability of any remaining provisions. m.Net may revise these Network Terms of Use at any time by updating this posting without notice to You. You are bound by such revisions and should therefore revisit this page each time to review the then current Network Terms of Use by which You are bound.
